What’s involved in “summary probation” in California?
I was caught in a sting and cited for gardening without a contractor’s license (job can’t be over $500) and asking for half up front. They said only 10% “deposit” is the law. I didn’t know about these laws. I pled not guilty and thought a jury would acquit but the public defender I was assigned tells me I have no chance to win and that I could be facing up to 6 months jail time for each count. I’ve have been in court 7 times in 7 months trying to resolve it. My latest “deal” from them is $800 and 3 years of summary probation. It started out as $5000 and 3 yrs. Why is this not negotiable, can I leave the state/country, purchase a firearm, what are my limitations. For a nonviolent crime, this seems a harsh penalty. My PD says I should take their offer and that summary probation is no big deal but I don’t trust anything he says. I’m trying to negotiate for a lesser fine and no probation; I’ve been basically on probation for the past 7 months – can’t this count as “time served?”
